TERMS AND CONDITIONS OF THE SOFT TENNIS SHOP ONLINE STORE
Terms and Conditions of 22.07.2026, setting out, among other things, the rules for concluding contracts through the Store, and containing the most important information about the Seller, the Store and Consumer rights.
This is a translation provided for convenience. The Polish version of these Terms and Conditions is the binding one.

§ 1 Definitions
Working days – days from Monday to Friday, excluding public holidays in Poland.
Civil Code – the Polish Act of 23 April 1964, the Civil Code.
Consumer – a Buyer who is a natural person, buying in the Store or taking steps towards making a purchase, without a direct connection with their business or professional activity.
Account – a digital service, governed by separate terms, within the meaning of the Act on consumer rights, through which the Buyer may use additional Store functions free of charge.
Buyer – any entity buying in the Store or taking steps towards making a purchase.
Privileged Buyer – a Consumer or a Privileged Entrepreneur.
Privileged Entrepreneur – a Buyer who is a natural person, concluding or intending to conclude with the Seller a contract under these Terms directly connected with their business activity, but not of a professional character for them.
Terms – these terms and conditions.
Store – the Soft Tennis Shop online store operated by the Seller at soft-tennis.eu.
Seller – HORCHA Spółka z ograniczoną odpowiedzialnością with its registered office at ul. Sadowa 21, 05-825 Grodzisk Mazowiecki, Poland, entered in the National Court Register (register of entrepreneurs) kept by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register, under KRS number 0000371294, NIP (VAT ID) 5291788833, REGON 142689307, share capital PLN 5,000.00.
Act on consumer rights – the Polish Act of 30 May 2014 on consumer rights.
§ 2 Contacting the Seller

- The cost of data transmission incurred by the Buyer results from the basic tariff of the internet service provider whose services the Buyer uses.
§ 3 Technical requirements
- For the Store to function properly, you need: a device with internet access and a web browser supporting JavaScript and cookies.
- To place an order in the Store, in addition to the requirements set out in point 1, an active e-mail account is necessary.
§ 4 Purchasing in the Store
- The product prices visible in the Store are total prices for the product, including VAT.
- The Seller points out that the total price of the order consists of the product price indicated in the Store and, where applicable, the cost of delivery of the goods.
- The product selected for purchase should be added to the cart in the Store.
- The Buyer then chooses the method of delivery and the payment method for the order from the options available in the Store, and provides the data necessary to fulfil the order placed.
- The order is placed at the moment the Buyer confirms its content and accepts the Terms.
- Placing an order is equivalent to concluding a contract between the Buyer and the Seller.
- The Buyer may register in the Store, i.e. create an Account, or make purchases without registration by providing their data with each order.
§ 5 Payments
- The following payment methods are available in the Store:
- BLIK;
- payment card: Visa, Mastercard;
- fast transfers, Apple Pay and Google Pay via PayU;
- PayPo deferred payment (buy now, pay later);
- traditional bank transfer based on a pro forma invoice – available to Buyers with a verified B2B-status account.
- For the payments referred to in point 1 letters a–d, payment is made at the moment of placing the order. For payment based on a pro forma invoice, the order must be paid for within 7 days of placing it; failure to pay within this period results in cancellation of the order.
- By making purchases in the Store, the Buyer accepts the Seller's use of electronic invoices. The Buyer has the right to withdraw this acceptance.
§ 6 Order fulfilment
Pre-order period: during the pre-order period, orders are fulfilled (dispatched) from 30.09.2026. The fulfilment times "1–2 working days" and "same-day dispatch for orders paid by 12:00" indicated in the Store apply after the end of the pre-order period.
- The order fulfilment time is indicated in the Store.
- Where the Buyer has chosen to pay for the order in advance, the Seller will proceed with fulfilling the order once it has been paid for.
- Where, within a single order, the Buyer has purchased products with different fulfilment times, the order will be fulfilled within the time applicable to the product with the longest fulfilment time.
- Goods are delivered within the territory of the countries indicated in the Store on the "Shipping and Delivery" page. For deliveries outside the customs territory of the European Union, customs duties and taxes may be charged in the destination country; these are borne by the Buyer and are not included in the order price.
- The following delivery methods are available in the Store: by courier company and to InPost parcel lockers.
§ 7 Right of withdrawal
- A Privileged Buyer has the right to withdraw from a contract concluded with the Seller through the Store, subject to § 8 of the Terms, within 14 days without giving any reason.
- The withdrawal period expires 14 days from the day:
- on which the Privileged Buyer took possession of the goods, or on which a third party other than the carrier and indicated by the Privileged Buyer took possession of the goods;
- on which the Privileged Buyer took possession of the last item, batch or part, in the case of a contract obliging the transfer of ownership of multiple goods delivered separately, in batches or in parts.
- For a Privileged Buyer to exercise the right of withdrawal, they must inform the Seller, using the contact details given in § 2 of the Terms, of their decision to withdraw from the contract by way of an unequivocal declaration (for example, a letter sent by post or e-mail). A Buyer holding an Account may also report a return from within the Account.
- The Privileged Buyer may use the withdrawal form template included at the end of the Terms, but this is not obligatory.
- To meet the withdrawal deadline, it is sufficient for the Privileged Buyer to send information concerning the exercise of their right of withdrawal before the withdrawal period expires.
Effects of withdrawal
- In the event of withdrawal from the contract, the Seller returns to the Privileged Buyer all payments received from them, including the cost of delivering the goods (except for additional costs resulting from the delivery method chosen by the Privileged Buyer other than the cheapest ordinary delivery method offered by the Seller), without delay and in any case no later than 14 days from the day the Seller was informed of the decision to exercise the right of withdrawal.
- The Seller will refund the payment using the same payment methods used by the Privileged Buyer in the original transaction, unless the Privileged Buyer agrees to a different solution; in any case, the Privileged Buyer will not incur any fees in connection with this refund.
- The Seller may withhold the refund until it has received the goods or until it has been provided with proof of their return shipment, whichever occurs first.
- The Seller requests that goods be returned to: ul. Sadowa 20, 05-825 Grodzisk Mazowiecki, Poland, without delay and in any case no later than 14 days from the day the Privileged Buyer informed the Seller of the withdrawal from the sales contract. The deadline is met if the Privileged Buyer sends back the goods before the 14-day period expires.
- The Privileged Buyer bears the direct cost of returning the goods.
- The Privileged Buyer is liable only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
- Where a refund is required for a transaction made by the Privileged Buyer with a payment card, the Seller will make the refund to the bank account assigned to that payment card.
§ 8 Exceptions to the right of withdrawal
- The right of withdrawal from a distance contract referred to in § 7 of the Terms does not apply to a contract:
- in which the subject of performance is non-prefabricated goods, produced to the Privileged Buyer's specification or serving to satisfy their individual needs;
- in which the subject of performance is goods delivered in sealed packaging which, once opened, cannot be returned for health protection or hygiene reasons, if the packaging was opened after delivery;
- in which the subject of performance is goods which, after delivery, due to their nature, become inseparably combined with other items.
§ 9 Complaints
I. General provisions
- The Seller is liable towards the Privileged Buyer for the conformity of performance with the contract, as provided for by generally applicable law, in particular the provisions of the Act on consumer rights.
- The Seller requests that complaints (including those concerning the operation of the Store) be submitted to the postal or electronic address indicated in § 2 of the Terms.
- If a guarantee has been granted for a product, information about it and its conditions is available in the Store.
- The Seller will respond to a complaint within 14 days of receiving it.
II. Privileged Buyers
A. Goods
- In the event of non-conformity of the goods with the contract, the Privileged Buyer may exercise the rights set out in Chapter 5a of the Act on consumer rights.
- The Seller is liable for non-conformity of the goods with the contract existing at the time of delivery and revealed within two years of that time.
- Under the provisions of the Act on consumer rights, in the event of non-conformity of the goods with the contract, the Privileged Buyer may demand: replacement of the goods or repair of the goods.
- Additionally, the Privileged Buyer may submit a declaration of price reduction or withdrawal from the contract where:
- the Seller has refused to bring the goods into conformity with the contract in accordance with Article 43d(2) of the Act on consumer rights;
- the Seller has failed to bring the goods into conformity with the contract in accordance with Article 43d(4)–(6) of the Act on consumer rights;
- the non-conformity of the goods with the contract persists, even though the Seller has attempted to bring the goods into conformity with the contract;
- the non-conformity of the goods with the contract is significant enough to justify a price reduction or withdrawal from the contract without first using the remedies set out in Article 43d of the Act on consumer rights;
- it is clear from the Seller's declaration or the circumstances that the Seller will not bring the goods into conformity with the contract within a reasonable time or without excessive inconvenience to the Privileged Buyer.
- In the case of goods subject to repair or replacement, the Privileged Buyer should make the goods available to the Seller. The Seller collects the goods from the Privileged Buyer at its own cost.
- The Privileged Buyer may not withdraw from the contract if the non-conformity of the goods with the contract is insignificant.
- In the event of withdrawal from the contract referred to in this section, the Privileged Buyer returns the goods to the Seller without delay at the Seller's cost, to the address ul. Sadowa 20, 05-825 Grodzisk Mazowiecki, Poland. The Seller refunds the price without delay, no later than within 14 days of receiving the goods or proof of their return shipment.
- The Seller returns to the Privileged Buyer the amounts due as a result of exercising the right to a price reduction without delay, no later than within 14 days of receiving the declaration of price reduction.
B. Out-of-court complaint and redress procedures
- The Seller informs the Consumer of the possibility of using out-of-court complaint and redress procedures. The rules of access to these procedures are available at the offices or on the websites of the entities authorised to resolve disputes out of court. The Consumer may use, among others:
- the assistance of the relevant European Consumer Centre from the European Consumer Centres Network; the list of Centres is available at: https://konsument.gov.pl/eck-w-europie/;
- mediation conducted by the locally competent Voivodeship Inspectorate of Trade Inspection; the list of Inspectorates: https://uokik.gov.pl/wojewodzkie_inspektoraty_inspekcji_handlowej.php;
- the assistance of the locally competent permanent consumer arbitration court operating at the Voivodeship Inspectorate of Trade Inspection; the list of courts: https://uokik.gov.pl/stale_sady_polubowne.php.
- The preceding provision is for information purposes and does not constitute an obligation on the Seller to use out-of-court dispute resolution methods. Their use is voluntary for both parties.
- The Consumer may additionally use the free assistance of a municipal or district consumer ombudsman.
III. Buyers other than Privileged Buyers
- In the event of a defect in the goods, a Buyer other than a Privileged Buyer may file a complaint about the defective goods under the statutory warranty regulated in the Civil Code.
- Towards a Buyer other than a Privileged Buyer, the Seller is liable under the statutory warranty if a physical defect is found within two years of the goods being handed over to the Buyer.
- In accordance with the Civil Code, a Buyer who is an entrepreneur other than a Privileged Entrepreneur loses their statutory warranty rights if they did not examine the goods at the time and in the manner customary for goods of that kind and did not notify the Seller of the defect without delay.
- Using the statutory warranty, a Buyer other than a Privileged Buyer may, under the rules set out in the Civil Code: submit a declaration of price reduction, submit a declaration of withdrawal from the contract in the case of a significant defect, demand replacement of the goods with defect-free ones, or demand removal of the defect.
- Goods under complaint should be delivered to ul. Sadowa 20, 05-825 Grodzisk Mazowiecki, Poland.
§ 10 Product reviews
- The Store publishes product reviews originating exclusively from Buyers who purchased the given product in the Store. The Seller ensures that published reviews come from its customers by linking the ability to post a review with the Buyer's Account and order history.
- Reviews are published after moderation, the sole purpose of which is to eliminate unlawful or offensive content or content unrelated to the product. Moderation does not consist in removing negative reviews.
- The Seller does not post or commission false reviews and does not publish sponsored reviews.
§ 11 Personal data
- The controller of personal data provided by the Buyer while using the Store is the Seller. Detailed information on the processing of personal data by the Seller — including the other purposes and grounds for data processing, as well as data recipients — can be found in the Privacy Policy available in the Store.
- The purpose of the Seller's processing of the Buyer's data provided in connection with purchases in the Store is order fulfilment. The basis for processing personal data in this case is: the contract or actions taken at the Buyer's request aimed at concluding it (Article 6(1)(b) GDPR), the Seller's legal obligation related to accounting (Article 6(1)(c) GDPR), and the Seller's legitimate interest in processing data to establish, pursue or defend possible claims (Article 6(1)(f) GDPR).
- Providing data by the Buyer is voluntary, but at the same time necessary to conclude the contract. Failure to provide data will make it impossible to conclude a contract in the Store.
- The Buyer's data provided in connection with purchases in the Store will be processed until: the contract concluded between the Buyer and the Seller ceases to be in force; the Seller ceases to be under a legal obligation requiring it to process the Buyer's data; the possibility of pursuing claims by the Buyer or the Seller related to the contract concluded through the Store ceases; the Buyer's objection to the processing of their personal data is accepted, where the basis for processing was the Seller's legitimate interest — depending on what applies in the given case.
- The Buyer has the right to demand: access to their personal data, its rectification, erasure, restriction of processing, transfer of data to another controller, and the right to object at any time to the processing of data for reasons related to the Buyer's particular situation — against the processing of personal data concerning them based on Article 6(1)(f) GDPR.
- To exercise their rights, the Buyer should contact the Seller using the details in § 2 of the Terms.
- If the Buyer considers that their data is being processed unlawfully, they may lodge a complaint with the President of the Personal Data Protection Office (UODO).
§ 12 Reservations
- The Buyer is prohibited from providing unlawful content.
- Each order placed in the Store constitutes a separate contract and requires separate acceptance of the Terms. The contract is concluded for the time and purpose of fulfilling the order.
- All contracts concluded under these Terms are governed by Polish law, subject to point 4.
- The choice of Polish law for contracts concluded under the Terms with a Consumer does not revoke or limit that Buyer's rights under mandatory provisions of law applicable to the Consumer in situations where no choice of law is made. If the national provisions applicable to a given Consumer provide broader protection than that resulting from these Terms or Polish law, the broader protection applies.
- Contracts concluded under these Terms are concluded in Polish.
- In the event of a dispute with a Buyer who is not a Privileged Buyer, related to a contract concluded through the Store, the competent court will be the court competent for the Seller's registered office.
